Ofile provides a streamlined and secure file transfer service for individuals over the age of 18 (or be 13 or older with parental consent) and legitimate organizations which are capable of cognitive behavior and liability for the terms in “Terms of Service“ below.
As an user of Ofile, you acknowledge that you have read and understood the “Terms of Service”, accepted these Agreements, and agreed to be bound by them. Ofile reserves the right to change these terms and conditions at any time without prior notice. On the event that any changes are made, the revised terms and conditions shall be posted on this website immediately
Following terms, “you“ means “user of the service“ and “us“ means “the service provider of Ofile.“

Ofile is file transfer service and free for 5GB file size limit. After file is uploaded successfully, you can send file by link or keycode that Ofile provides
Uploaded files are stored and available to download on Ofile’s servers for 72 hours and will expire automatically after. You will be notified of the expiration date in the link of file. After the expiry time, Ofile will permanently delete the uploaded files. These files will not be available nor retrievable.
Using Ofile service, you can send large files for free anytime, anywhere with any internet access device as smartphones, laptops, tablets,… without registering account.
We may change, add, suspend, cancel, remove or otherwise modify the services offered on this website at any time without prior notice. You acknowledge and agree that Ofile is not liable for any damage to you or any third party for any change, suspension or termination of the Service. At the same time, we may set general practices and limits regarding use of the Service.

Ofile understands that Data Privacy is a must for all Internet users and the protection of personal information is the most important thing we must guarantee. Therefore, we are committed to provide you with a safe, secure and reliable experience. This commitment means to ensure your protection obligations as well as respectyour privacy and choice.
Any file transfer between you and recipients is treated confidentially. Ofile does not provide any public search function, catalogue or list to find files that would be available.
We will not rent or sell your personally identifiable information to any third party. However, we may disclose your personal information or information of any files if we believe that disclosure is necessary and reasonable to:
• Obey the law, regulations or legal requirements.
• Cooperate with investigations about illegal activities.
• Identify people who might have violated the law or legal notice.
• Defend the interests of Ofile or third parties.
• Protect the safety of an individual or a group.
• Detecting and Preventing Fraud, Waste and Abuse.

Ofile does not claim any ownership of the files content you transfer through our Services. By using our Services, you agree that you are fully and solely responsible and accountable for the files you transfer. So, you can only transfer files if they’re yours, or if you have the permission from the owner to do so. Ofile is not liable to you or any third party for any damages arising out of the content shared by you.
You assume full personal, organizational and legal responsibility for any data that is corrupted, lost or irrecoverable.
You are solely responsible for everything you share or any interactions you have through Ofile

As a condition to make use of the Services you agree not to transfer, distribute or share any files have:
• feature child pornography.
• are obscene, defamatory, libelous, slanderous, profane, indecent or unlawful.
• promote racism, violence or hatred.
• are factually inaccurate, false, misleading or deceptive.
• constitute ‘hate speech’, whether directed at an individual or a group, and whether based upon the race, sex, creed, national origin, religious affiliation, sexual orientation or language of such individual or group, and/or.
• facilitate or promote gambling, or the sale or use of liquor, tobacco products or illicit drugs.
You don’t have the right to copy and/or transfer file that violate or misappropriate intellectual property rights, privacy rights, include data protection rights, and/or any other kind of rights; infringe on or violate any applicable law or regulation of the host state where you share the file.

It is prohibited to violate the system or intentionally disrupt Ofile's services, violators will be accountable before the law about civil and criminal liability . Includes some of the following but not limited to:
Illegal access to or use of Ofile Services, including those that probe, scan or test a system's sensitivity, security breach or proprietary rights without the express permission of Ofile.
Interfere with the Services of any customer or computer network, include but not limited to activities such as intentionally overload the bandwidth or attack the system on a large scale; or use any device, software, or program to interfere with normal service activities or any unreasonably large file uploads on Ofile's infrastructure.
In addition, you agree not to:
• impersonate or falsely pretend affiliation with any person or entity.
• access any non-public areas of the Ofile website or Services.
• send viruses, worms, malware, junk mail, spam, chain letters, phishing mails, unsolicited promotions or advertisements of any kind and for any purpose.
• attempt to probe, scan, compromise or test the vulnerability of the Ofile website or Services or any related service, system or network or breach any security or authentication

Ofile reserves the right to investigate, provide to third parties, (temporarily) block and/or remove from its servers, without warning, any transfers, files, wallpapers and/or accounts or to block anyone from accessing any part of the Ofile website or Services, when we ascertain that you violate these Terms of Service or act in violation of any applicable law or regulation.
You know and agree that Ofile has the rights to delete, move, archive (include account information, usage behavior) or any contents uploaded to Ofile that can be specified as violating to “Terms” and we can terminate your access to our Services.
In addition, if the client violates this policy, Ofile will support and associate with the administrative and principal in collecting and transfering the information about the user , user’s website, illegal content, and the users who can be accessible, collect or use the contents of these content

These Terms of Service are governed by Vietnam law. These Terms of Service will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.
Any disputes regarding these Terms of Service will be submitted to the Court that has jurisdiction under Vietnam law.
